Terms of Service

These Terms of Service govern your access to and use of Mandarin Ear. By using the service, you agree to these terms.

1. Eligibility and Account Responsibilities

You must be legally capable of entering into binding agreements in your jurisdiction to use the service. You are responsible for maintaining accurate account information and safeguarding account credentials.

You are responsible for all activities that occur under your account unless unauthorized access results from our failure to apply reasonable security controls.

2. Acceptable Use

You agree to use Mandarin Ear only for lawful purposes and in accordance with these terms. You must not misuse the service, interfere with security, or attempt unauthorized access.

  • No automated scraping or abusive traffic patterns
  • No reverse engineering except where permitted by law
  • No infringement, fraud, or unlawful content distribution

3. Monthly Donut Race

The Monthly Donut Race is a skill-based monthly challenge in which eligible participants are ranked by qualifying XP earned during the applicable UTC month. No purchase is necessary. The top 10 eligible participants receive that month’s virtual donut collectible, which has no monetary value and is not transferable.

Participation in the Monthly Donut Race is subject to the Official Rules.

4. Intellectual Property and License

The service, including software, branding, and original content provided by Mandarin Ear, is protected by intellectual property laws. We retain all rights not expressly granted.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal or internal learning purposes.

5. Third-Party Services

Mandarin Ear may integrate third-party services, including authentication, hosting, analytics, and payment providers. Your use of third-party services may be subject to their separate terms and privacy policies.

6. Suspension and Termination

We may suspend or terminate access if you materially breach these terms, create legal or security risk, or engage in abusive conduct.

You may stop using the service at any time. Termination does not affect rights or obligations that by nature should survive termination.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Mandarin Ear and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or business opportunities.

Our aggregate liability arising out of or related to the service is limited to the amount paid by you for the service in the twelve months preceding the event giving rise to liability, or one hundred U.S. dollars (USD 100), whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless Mandarin Ear from claims, liabilities, damages, losses, and expenses arising from your misuse of the service, violation of these terms, or infringement of third-party rights.

10. Changes to the Service or Terms

We may modify or discontinue features and may update these terms from time to time. Material updates become effective when posted unless a later date is stated.

11. Governing Principles and Dispute Resolution

These terms are interpreted and enforced in accordance with applicable law. Disputes should first be addressed through good-faith negotiation by contacting us.

If a dispute cannot be resolved informally, either party may seek relief in a competent forum with jurisdiction under applicable law.
